1. Overview

These Terms and Conditions govern your purchase and use of software products sold through shop.modeltok.com ("the Store"), operated by Bartłomiej Tokarzewski, a sole proprietor based in Poland ("ModelTok", "we", "us").

By purchasing or using our products, you agree to these terms.

2. Products

We sell desktop software applications for engineering and building science. Each product listing specifies its features, supported platforms, and pricing.

3. License

Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the software on any number of devices you personally own. You may not:

• Redistribute, resell, or sublicense the software
• Reverse engineer, decompile, or disassemble the software beyond what applicable law permits
• Remove or alter any proprietary notices or labels

The software is provided under the MIT License where applicable to its open-source components. Proprietary components remain the intellectual property of ModelTok.

4. Pricing and Payment

Prices are listed in EUR and are one-time payments unless otherwise stated. All prices include applicable taxes. Payment is processed by our third-party payment provider. We do not store your payment card details.

5. Delivery

Software is delivered digitally. After purchase, you will receive download links via email or through your account. Delivery is immediate upon successful payment.

6. Updates

One-time purchases include free updates for the major version purchased (e.g., purchasing v1.x entitles you to all 1.x updates). Major version upgrades may require a separate purchase at a discounted rate.

7. Disclaimer of Warranties

The software is provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, ModelTok shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software. Our total liability shall not exceed the amount you paid for the product.

9. Governing Law

These terms are governed by the laws of Poland. For EU consumers, mandatory consumer protection laws of your country of residence apply where they offer greater protection.

10. Changes to Terms

We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our products after changes constitutes acceptance.
